NSW: Sydney identity Bayeh involved in shootout, jury told

A court has been told a dispute about a jacket escalated into a shootout outside arestaurant when Sydney identity LOUIS BAYEH allegedly shot a man in the shoulder.

Forty-eight-year-old BAYEH has pleaded not guilty to maliciously discharging a firearmand causing grievous bodily harm to MOUSTAFA LAALAA on July 2, 2000 in Sydney's south.

Crown Prosecutor PATRICK BARRETT told the NSW District Court jury that BAYEH was diningwith SAM EL-MASRI at a Narwee restaurant on the night of the shooting while Mr LAALAAwas having a family celebration at another table.

Mr LAALAA and Mr EL-MASRI, who'd been at odds for a week over the sale of a jacket,met outside the diner and began arguing loudly.

Mr BARRETT says the jury would hear in evidence that BAYEH soon joined the pair butwas told to get back inside.

He's told the court BAYEH was angry at the way he was spoken to and pulled a gun on LAALAA.

In the ensuing struggle, LAALAA, BAYEH and a man who left the restaurant for a cigaretteall sustained gunshot wounds.

The hearing continues before Judge IAN DODD.
